Subscriber Terms & Conditions

These Terms & Conditions (Terms) apply to every subscription to the Cove Live service (Service), operated by Cove Technologies (Cove Live, we, us). By subscribing to, trialling or using the Service, you (the Subscriber) agree to these Terms.

1. The Service

Cove Live is a subscription display service that provides live sports scores, fixtures, odds and venue promotional content for display on LED screens and tickers in commercial venues. The Service includes access to a browser-based management portal for configuring sports, scheduling promotional content and managing your display.

2. Authorised display - COVE media player only

The Service is licensed for display only through an authorised COVE media player supplied by Cove Technologies.

One subscription licenses one screen, at one venue, driven by one COVE media player. The licence is per screen, per media player: owning a COVE media player does not entitle the Subscriber to display the Service on more than one screen, and a subscription does not extend to any additional screen, room or venue. Each additional screen requires its own subscription and its own COVE media player. (For clarity, a single LED ticker purchased from Cove Technologies is one screen.)

The following are not permitted and constitute unauthorised use of the Service, which we treat as piracy:

  • Displaying the Service through any media player, device or hardware other than a COVE media player.
  • Displaying the Service on more than one screen per subscription, including by connecting a COVE media player to multiple screens or by using splitters, matrixes, daisy-chaining or any other signal-distribution equipment to duplicate the output onto additional screens.
  • Playing the Service from a computer, laptop, tablet, phone or web browser to patrons in a venue, or otherwise using the browser portal as a public display.
  • Streaming, mirroring, re-broadcasting, recording or re-transmitting the Service to any other screen, venue or platform.
  • Sharing portal login credentials with, or sub-licensing the Service to, any other venue or business.

The browser portal (including the free trial preview) is provided for configuration, preview and evaluation purposes only. Unauthorised display of the Service may result in immediate suspension or termination of the subscription without refund, and we reserve our rights to pursue any other available remedy.

3. Third-party data - logos, scores and odds

Team and league logos displayed by the Service are provided by third-party API sources.

Trademarks and ownership. All league, competition, club and team names, logos, emblems, crests, colours and other marks displayed by the Service (including those of the AFL, NRL, NBA, NBL, NFL, Premier League, cricket competitions and MLB, and their member clubs and teams) are registered or unregistered trademarks and the intellectual property of their respective leagues, clubs, teams and governing bodies. Cove Live claims no ownership of any such mark. These marks are displayed for identification and informational purposes only, as supplied by third-party data providers, and their display does not imply any affiliation with, sponsorship by, or endorsement from any league, club, team or governing body. Nothing in these Terms grants the Subscriber any right or licence in any such mark, and Subscribers must not extract, copy, reproduce or reuse any logo, mark or data obtained through the Service for any purpose outside the ordinary display of the Service.

Scores, fixtures and odds displayed by the Service are provided by third-party API sources. While we work with reputable data providers, we do not control this data and we accept no responsibility or liability if any score, fixture, time or odd displayed is inaccurate, incomplete, delayed or unavailable. The Subscriber acknowledges that all such data is supplied on an "as is" basis from third-party providers and should not be relied upon for any wagering, commercial or other decision.

4. Odds display and gambling compliance

Odds displayed by the Service are for general information only and do not constitute betting advice or an inducement to gamble. The Subscriber is solely responsible for ensuring that the display of odds and any related content in its venue complies with the laws, licensing conditions and gambling-advertising rules that apply in its state or territory. The odds display feature can be switched off in the portal at any time.

5. Subscriptions, trials and payment

  • Subscriptions are sold in 12-month terms and billed annually in advance. Current pricing, packages and add-ons are published at covelive.com.au.
  • Each subscription covers one screen at one venue (clause 2). Venues wanting the Service on multiple screens require a separate subscription and COVE media player for each screen.
  • Every subscription requires a COVE media player, purchased separately at the published one-off price (ex GST), except where included with an LED ticker purchase.
  • LED tickers purchased from Cove Technologies include a COVE media player, portal access and the first month of the full package. The one-month inclusion applies to ticker purchases only.
  • Fees are payable within the terms shown on the invoice. We may suspend the Service where an account remains unpaid after reasonable notice.
  • Except where required by law (including the Australian Consumer Law), subscription fees are non-refundable.

6. Subscriber content

The Subscriber is responsible for all content it uploads to the Service, including venue logos, promotional banners and sponsor material. The Subscriber warrants that it owns or is licensed to use all uploaded content, and that no uploaded content is unlawful, misleading, offensive or infringes any third party's rights. We may remove content that we reasonably consider breaches this clause. The Subscriber indemnifies us against any claim arising from content it uploads.

7. Service availability

The Service relies on internet connectivity, third-party data feeds and hosting infrastructure. While we aim for high availability, we do not guarantee that the Service will be uninterrupted or error-free. We may perform maintenance, updates or improvements from time to time and will endeavour to minimise disruption. The Subscriber is responsible for providing suitable power, internet connectivity and screen hardware at its venue (existing hardware dependent - compatibility of subscriber-owned LED screens is assessed but not guaranteed until confirmed by us).

8. Intellectual property

All intellectual property in the Service - including the Cove Live software, portal, design and branding - remains the property of Cove Technologies or its licensors. Subscribers receive a limited, non-exclusive, non-transferable licence to use the Service for the subscription term at the nominated venue, and gain no other rights.

9. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. To the maximum extent permitted by law, and subject to the preceding sentence: (a) the Service is provided "as is"; (b) we exclude all other warranties, whether express or implied; (c) we are not liable for any loss of revenue, profit or opportunity, or any indirect or consequential loss, including any loss arising from inaccurate or unavailable third-party data (including scores, fixtures, logos and odds); and (d) our total liability in connection with the Service is limited, at our election, to re-supplying the Service or refunding the fees paid for the then-current subscription period.

10. Termination

We may suspend or terminate a subscription immediately where the Subscriber breaches these Terms, including any unauthorised display under clause 2 or failure to pay under clause 5. The Subscriber may choose not to renew at the end of a subscription term. On termination, the Subscriber's licence to display the Service ends immediately and access to the portal may be disabled. Clauses which by their nature survive termination (including clauses 3, 6, 8 and 9) continue to apply.

11. Privacy

We collect and handle account and contact information in accordance with our Privacy Policy, available at covelive.com.au. We do not sell subscriber information.

12. Changes

We may update these Terms from time to time. Material changes will be notified to Subscribers by email or through the portal at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. We may also improve, modify or discontinue features of the Service, provided the core service described in clause 1 remains materially the same during a paid subscription term.

13. General

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts. If any clause is found unenforceable, the remainder of the Terms continue in force. These Terms, together with the applicable subscription order and published pricing, are the entire agreement between the parties in relation to the Service.
